TERMS AND CONDITIONS

  1. Disclaimer of Warranties

    All software and services are provided by Test Ultimate Limited (the company), and are on an ‘as is’ and ‘as available’ basis with no warranties of any kind. This does not affect your statutory rights.
  2. Changes to Driving Test Date and Time

    By using Test Ultimate, and providing us with your driving licence number, you agree to us making changes to your driving test date and time on your behalf.
  3. Company’s Affiliation with the DVSA

    The company has no affiliation with the Driver and Vehicle Standards Agency (DVSA). Subscription to this service does therefore not guarantee to find you an earlier test date. However, if no date is found until after 3 weeks of the earliest date you ask for (applies only to our general packages) and 3 weeks after your most recent upgrade payment (if applicable), a refund will be given on request so you are not left out of pocket. Under no circumstances will a refund exceed the original amount paid to us. Test Ultimate reserves the right to determine the amount and method of refunds at all time, and to hold a refund for an indefinite time if a refund cannot be made to the original payment method (for fraud prevention reasons). Once any refund is made we will immediately stop searching for a test for you. Our processing fee is non refundable.
  4. Refund Policy

    If your booking is limited for any reason such as but not limited to your theory test expiring within 3 months of the earliest date asked for, requesting the earliest date with less than 10 working day gap from your previous driving test booking or cancelling the test you provide us details with, this will nullify any refund policy we have.
  5. Limitations to Refund Policy

    If you accept a test date, it then becomes your responsibility to cancel it, if needed. We will only be able to find another test for you if you pay the sign up fee again.
  6. Upgrading Package

    Certain packages may be upgraded by the user at any time but it is not possible to then downgrade those packages. Any upgrade fees paid are non refundable unless we are unable to find a test for you in accordance with clause 3, above.
  7. Company’s Liability for DVSA Actions

    We cannot be held responsible for the DVSA changing the date and/or time of your test, or for them cancelling the test for reasons including but not limited to the driving examiner illness, or due to weather conditions, such as snow, ice or fog. In such a case you will need to purchase another package from us if you would like us to find you a new test date.
  8. Responsibility for Providing Valid Information

    It is your responsibility to provide us with valid details, if you fail to provide valid details, provide details of a test that is earlier than 3 weeks from the earliest test date you asked for or if you cancel a test that you provide us details with, we will still begin searching as soon as you have signed up however we will be unable to book any slots until valid information is provided, we may also limit the number of tests offered to you and may even pause your search until this information is provided. Providing invalid details or cancelling your booking with DVSA will nullify any refund policy we have.
  9. Free Retest

    The Ultimate package offered on our website includes 1 free retest cancellation. This means if you fail the first test we provide you with, we will find another cancellation for you free of charge, the booking for the next test will need to be made by you, this can then be changed by us once we find another cancellation for you. This offer is non transferable or refundable and we will only be able to provide you with this should you fail the test we have given you. The free retest you get will not be Priority or Super Priority, however this can be upgraded by you via your account (for an additional fee).
  10. Driving Test Offers

    We can provide unlimited driving test offer notifications until you confirm you would like to be booked in for a slot. Once you confirm we will attempt to book that in for you within 24 working hours. We cannot be responsible if the booking fails, however in such cases we will continue searching for another test for you. Once the test is booked you will receive a confirmation email from the DVSA and we will no longer be able to provide any refunds or be able to change the slot without you purchasing another package.
  11. Short notice autobook feature

    1. Description

      The feature allows you to set an earliest date, a latest date and a time frame that you would like us to automatically book any test that comes up that meets the criteria in the test centres you have asked for. The Service is only for short notice tests (tests within 3 full working days).
    2. Eligibility

      The feature is currently only available to those on the Ultimate package or Dedicated Search packages.
    3. Booking Policy

      Once we have booked you in for a test, we can no longer make another change to the booking without you purchasing another package from us. The DVSA also has rules about changing short notice tests (see their website for details). We, therefore, strongly recommend that you only set the autobook to date and time frames that you know will work out with your schedule (and if necessary, your instructor also).
    4. Limitations

      The feature is subject to availability, and we do not guarantee that we will be able to book a test for you using this feature.
    5. Other Test Offers

      We will still offer you other tests, even if they do not match your autobook criteria. However, we will not automatically book those until you confirm.
  12. Dedicated Search packages

    1. Description

      The packages provide a dedicated search just for that customer, it allows you to set criteria that you would like us to automatically book any test that comes up that meets the criteria in the test centres you have asked for.
    2. Eligibility

      The feature is currently only available to those on the Dedicated Search packages.
    3. Booking Policy

      1. Once your test is booked, any further changes to the booking can only be made upon your request through your account, provided you have not made any previous changes to the booking. Please note that additional charges may apply if you have exhausted or have no free change allowance.
      2. Upon receiving your change request, we will respond within 3 working days. If you have not made any changes to the booking with DVSA, we will approve the request and initiate a search for an alternative test slot. However, if you modify the booking after we have commenced the search, the option for further changes will no longer be available. In such cases, you will be required to purchase another package to access our services again. If you have paid for the additional change feature, no refund will be provided.
      3. We comply with the DVSA's regulations regarding test changes. If the DVSA requires payment for changing the test, we will cancel the existing test and send you an email requesting you to rebook. If the booking reaches its change limit, we reserve the right to cancel the booking and request you to rebook. For detailed information on the DVSA's rules, kindly refer to their official website.
      4. We strongly advise that you select the autobook criteria only for date and time frames that align with your schedule and, if necessary, your instructor's schedule as well.
    4. Limitations

      1. Candidates must provide a minimum of 21 working days we can book the test on in your search criteria.
      2. Candidates must provide a minimum of 5 hours per day we can book the test on in your search criteria.
      3. The additional booking change feature is subject to availability, and we do not guarantee that we will be able to change all tests in time.
    5. Refunds

      If we fail to book a test within the date range you specified in your account, you can request a refund from us by contacting us provided you had provided search criteria, do not have your search paused and it is past the latest date you have set your search to. If we have booked a test and you requested a change to the test you will not be eligible for a refund. Any breach of our terms and conditions will nullify any refund policy we have.
  13. License Number Security

    When contacting us we will authenticate you by asking for your license number, if anyone else has this and uses it to gain unauthorised access to your account, we will not be able to take any liability for actions performed with this access. It is your responsibility to ensure to keep your license number secure.
  14. Responsibility of the Learner Driver

    The learner driver is responsible for turning up to the driving test, taking the correct documents and ensuring that the car they use is suitable for the test. We cannot be held responsible for any tests cancelled due to reasons that are the responsibility of the learner driver or their driving instructor including, but not limited, to the above learner driver responsibilities.
  15. Checking for Successful Changes

    It is learners responsibility to check with the DVSA that any changes made by us have been completed successfully before you make any further arrangements regarding your new driving test, such as but not limited to 1) organising and paying for any last minute driving lessons, 2) organising and paying for any transport to the test centre, 3) organising and paying for any accommodation near the test centre, and 4) taking time off work/college/school. We will always confirm to you any changes that we’ve been able to make to your test, and the DVSA will also confirm any changes to you if they have your email address – you must wait for confirmation from us and the DVSA before you start to make plans and preparations for your new driving test. We are not liable for any expenses or compensation caused by you incorrectly assuming your test has been changed.
  16. Test Types

    Our service is for standard car practical driving tests only, unfortunately we cannot obtain any other tests such as but not limited to: tests for those with special needs, extended tests, tests for those who have already passed a standard practical test, motorcycle tests.
  17. Instructor Reference Number

    We are unable to book any tests for you while there is a instructors reference number added to a booking, if we see this, we will remove it, this can then be added back by you after we have completed the booking.
  18. Usage Tracking

    We will record details of usage of the service including, but not limited to, your personal details provided at the time of taking out the services, search times, dates and times that are found, emails, calls, messages and any other form of communication that are sent to you, and received from you.
  19. Responsibility for changing or cancelling your driving test booking

    We cannot be held responsible for failing to change your test, it is your responsibility to change or cancel your booking before the latest date (mentioned in the booking confirmation email from the DVSA).
  20. SMS Notifications

    We will only send you SMS messages regarding tests for non short notice tests (more than 3 full workings days away) and if you have activated this feature via your account and have provided us with a valid UK mobile number. We cannot be held responsible for delivery delays in the SMS network although this is not very common to happen.
  21. Delayed Test Search

    In the event that DVSA and/or the specific test centres you have asked for stop offering any tests for a period of time, if you have asked us to search within this timeframe, we will delay the search until the first available day they are offering tests. This means a refund will only be possible if we haven’t found a date until 3 weeks after the delayed date.
  22. Data Protection

    By giving us your details you agree to us passing your information to the DVSA in order to change your driving test. All details will be held by us in accordance with the Data Protection Act.
  23. Public Response to Negative Reviews

    If you leave a negative review for us, we may reply to you publicly and include some information about the service we provided you, we will never reveal personal information or your test date publicly.
  24. Secondary Test Notification Email Address

    Apon request, Test Ultimate can add a secondary test notification email address for you, however only test offer emails will be sent to the secondary email address, all other emails will only be sent to the primary email address.
  25. Email Bounce Policy

    If any email sent to the email address provided by the user bounces, Test Ultimate Limited reserves the right to pause the search in the user's account until the issue is resolved and we are notified. As we cannot contact the user via email, we will not be able to provide any notification about the issue. It is the user's responsibility to ensure that the email address provided is valid and able to receive emails. Test Ultimate Limited will not be held responsible for any delays or losses resulting from an invalid email address or email address that is unable to receive our emails.
  26. Additional Charges For Evening, Bank Holiday, Or Weekend Tests

    If the test we find for you is an evening, bank holiday, or weekend test, the DVSA will charge £75 for these bookings, which is an additional £13 from the normal £62 fee. Therefore, we will charge an additional £13 plus our £2.99 processing fee for tests like these. If the original booking the user booked with the DVSA is a £75 booking, we will refund the £13 (the processing fee is non-refundable) after the booking is complete if the customer requests.
  27. Account Suspension For Misuse

    Each account purchased from us can only be used to search for practical driving tests for the driving licence number that is entered in the driving licence number box on the sign up form. We reserve the right to suspend accounts without refund where we believe the account is not being used according to this rule. We will make reasonable efforts to contact you before suspending your account. If you are a driving instructor and wish to use our services, please contact us to discuss our services that have been specifically designed for use by driving instructors.
  28. Chargeback And Dispute Policy

    In the event a dispute (otherwise known as chargeback) is raised for a payment made to us without prior request for a refund directly to us via email, we will levy a £22 charge to you. This is to cover the costs and penalties the banks charge us due to the dispute process which are enforced by them. We will also charge this fee to you if you dispute a transaction and are unsuccessfull in your claim (regardless if you have or have not contacted us prior). When a dispute is initially raised we will immediately pause your search without the need to inform you.
  29. Restrictions On Signing Up For Someone Else

    Only the owner themselves of the driving license number can sign up with us, you cannot sign up on behalf of someone else. If we suspect that you may be violating this term, we reserve the right to terminate your account with no refund. If you are a driving instructor and wish to use our services, please contact us to discuss our services that have been specifically designed for use by driving instructors.
  30. Contacting Customers

    By registering your details with the company, you agree to the company contacting you via the email address and mobile telephone number you provide on registration. Your personal details may be passed on to our third party providers such as, but not limited to, the DVSA (Driver and Vehicle Standards Agency).
  31. Copyright Protection

    All content included on this site, including text, graphics, logos, button icons, images and software, is the property of the company or its content suppliers and is protected by international copyright laws. Any attempt at reverse engineering, disassembly, or de-compilation of programs, unless it is explicitly permitted, is prohibited by law.
